General Terms And Conditions
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed through our online shop.
2. Contractual Partner, Conclusion of Contract
The purchase agreement is concluded with onTrade GmbH.
The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. You can place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the order process. By clicking the order button, you submit a binding order for the goods contained in the shopping cart. The confirmation of receipt of your order will be sent by e-mail immediately after the order has been submitted.
The time at which the contract with us is concluded depends on the payment method you have chosen:
Cash on Delivery
We accept your order by sending a declaration of acceptance in a separate e-mail or by delivering the goods within two days.
Advance Payment
We accept your order by sending a declaration of acceptance in a separate e-mail within two days, in which we will provide our bank details.
PayPal Plus (PayPal, Direct Debit, Credit Card, Invoice)
As part of the PayPal Plus payment service, we offer you various payment methods as PayPal services. After placing your order, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. The contract is concluded with us upon confirmation of the payment instruction.
3. Contract Language, Storage of Contract Text
The language available for the conclusion of the contract is German.
We store the contract text and send you the order details and our GTC by e-mail. For security reasons, the contract text is no longer accessible via the Internet after completion.
4. Delivery Conditions
The delivery conditions are comprehensively defined in the chapter Shipping Information.
We deliver only via shipping. Please understand that self-collection of goods is not possible.
5. Payment
The following payment methods are generally available in our shop:
Advance Payment
When selecting the advance payment method, we will provide our bank details in a separate e-mail and deliver the goods after receipt of payment.
Cash on Delivery
You pay the purchase price directly to the delivery agent. An additional fee of 5 euros will be charged. Furthermore, 2 euros must be paid directly to the delivery agent.
PayPal Plus (PayPal, Direct Debit, Credit Card, Invoice)
As part of the PayPal Plus payment service, we offer you various payment methods as PayPal services. You will be redirected to the website of the online provider PayPal, where you can enter your payment data, agree to the use of your data by PayPal, and confirm the payment instruction to PayPal.
If you choose PayPal as your payment method, you must be registered there or register first and log in with your access data. The payment transaction will be carried out automatically by PayPal immediately after confirming the payment instruction. Further information is provided during the ordering process.
If you choose the credit card payment method, you do not need to be registered with PayPal. The payment transaction will be carried out immediately after confirmation of the payment instruction and your authorization as the legitimate cardholder by your credit card company at PayPal’s request, and your card will be charged. Further information is provided during the ordering process.
If you choose the direct debit payment method, you do not need to be registered with PayPal. By confirming the payment instruction, you grant PayPal a direct debit mandate. You will be informed by PayPal about the date of the account debit (so-called prenotification). Upon submission of the direct debit mandate, PayPal will instruct its bank to initiate the payment transaction. The payment transaction will be carried out and your account will be charged. Further information is provided during the ordering process.
If you choose the invoice payment method, you do not need to be registered with PayPal. After a successful address and credit check and after placing the order, we assign our claim to PayPal. In this case, you can only make payment to PayPal with debt-discharging effect. For payment processing via PayPal, the PayPal terms and conditions and privacy policy apply in addition to our GTC. Further information and the complete PayPal terms and conditions for invoice purchase can be found here: https://www.paypal.com/de/webapps/mpp/ua/pui-terms?locale.x=en_DE.
6. Retention of Title
The goods remain our property until full payment has been received.
7. Transport Damage
If goods are delivered with obvious transport damage, please report such defects immediately to the delivery agent and contact us without delay. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us assert our own claims against the carrier or transport insurance.
8. Warranty and Guarantees
The statutory liability for defects applies. Information on any applicable additional guarantees and their exact conditions can be found with the respective product and on special information pages in the online shop.
Customer Service: You can reach our customer service for questions, complaints, and claims on working days by e-mail at info@usb-nachruesten.de.
9. Liability
We shall always be fully liable for claims arising from damages caused by us, our legal representatives, or agents
- in the event of injury to life, body, or health,
- in the event of intent or gross negligence,
- in the event of a guarantee, if agreed, or
- where the scope of the Product Liability Act applies.
In the event of a breach of essential contractual obligations, the fulfilment of which is necessary for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives, or agents, liability is limited to the foreseeable damage typical for the contract, which must typically be expected to occur. Otherwise, claims for damages are excluded.
10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which can be found here: https://ec.europa.eu/consumers/odr/.
We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
